Terms of Service

1. Provider and scope
These Terms of Service ("Terms") apply to the use of the TESTUNO platform ("TESTUNO", "we", "us"), operated by Steve Thomas Schütz, trading as JDMTarmac ("operator"). Full provider identification and contact details are set out in our Impressum. By accessing or using TESTUNO you agree to these Terms.
2. Eligibility and age
TESTUNO is available to users aged 16 and older for account creation (consistent with GDPR Art. 8 as implemented in Germany). Anonymous use of public tests is permitted from age 13. If you are under 16 you may not create an account. By creating an account you confirm that you meet these age requirements.
3. Nature of the service and test limitations
TESTUNO is a self-assessment, cognitive-benchmarking, informational and educational platform, and — for tests labelled evidence class D — an entertainment platform.
TESTUNO does not provide medical devices, medical services, clinical diagnostic services or medical screening services. TESTUNO tests, scores, reports and other outputs are not intended to diagnose, rule out, predict, prevent, monitor or treat any disease, disorder or medical or mental-health condition.
They are also not educational-placement instruments, employment-selection instruments, or a basis for insurance, credit or other high-impact decisions. Results must not be used as a substitute for evaluation by an appropriately qualified professional. If you have concerns about your health, please consult a qualified healthcare professional.
Every test carries a visible evidence class:
- A — Validated / published instrument. An established instrument with published evidence supporting its measurement properties and documented scoring. Validation and applicability may depend on version, language, population and intended use. A validated instrument is still not a clinical evaluation and TESTUNO's use of it is not a clinical diagnostic service.
- B — Research-grounded original. A TESTUNO-designed assessment grounded in established psychological or cognitive constructs, not independently validated as a standalone instrument.
- C — Direct benchmark. A directly observable measurement such as reaction time or words per minute. Results are affected by your device, input method, display refresh rate, operating system and environment, and are not laboratory-grade.
- D — Entertainment / self-reflection. Deterministic and internally consistent, but explicitly not a scientific or clinical assessment.
Percentiles are shown only when backed by a real stored norm with a sufficient sample size; otherwise no percentile is shown. Unless expressly stated otherwise, a percentile describes your position relative to the eligible TESTUNO norm sample for that test — not relative to the general population.
4. IQ Estimate limitations
The TESTUNO IQ test produces an "Estimated IQ" based on a structured online assessment. An Estimated IQ from TESTUNO is not equivalent to a clinically administered intelligence test such as the WAIS or Stanford-Binet. It is intended for informational and self-discovery purposes only. It must not be used for clinical, diagnostic, educational-placement, or employment-selection decisions.
5. Health-adjacent tests
Some tests address topics that may feel close to health or mental health — for example attention, memory, cognitive performance, mood, emotional wellbeing or emotional patterns. These tests are informational self-assessment and self-reflection tools. They are not clinical screening instruments, they do not diagnose or rule out any condition, and they cannot determine whether you have a medical or mental-health condition. Where such a test explores performance on a task, the result describes performance on that specific task under your own conditions — not a health status. If you are concerned about your cognitive or mental health, please seek advice from an appropriately qualified healthcare professional.
6. Payments
TESTUNO offers one-time premium reports behind transparent pricing. Prices are shown in your local currency and are inclusive of applicable German VAT where required. We do not offer subscriptions unless a product is explicitly labelled as recurring and shows the billing period and cancellation terms clearly. No fake urgency, countdowns or hidden charges are used.
7. Right of withdrawal (Widerrufsrecht)
You have a statutory right of withdrawal for distance contracts under German law (§§ 312g, 355 BGB). However, the right of withdrawal is excluded for digital content that is not supplied on a physical medium if you have expressly consented to commencement of delivery before the withdrawal period expires and have acknowledged that you lose your right of withdrawal upon complete fulfilment (§ 356 Abs. 5 BGB).
By checking the consent boxes at checkout and completing your purchase, you expressly agree to immediate delivery of your personalized report and acknowledge that you lose your right of withdrawal once the report has been fully generated and delivered.

Consumers have the following right of withdrawal:
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day the contract is concluded.
Exclusion: The right of withdrawal expires early for digital content that is not supplied on a physical medium if you have expressly consented to commencement of delivery before the withdrawal period expires and have acknowledged that you lose your right of withdrawal through this consent.
To exercise the right: To exercise your right of withdrawal you must inform us (Steve Thomas Schütz / JDMTarmac, contact details in our Impressum, email: jdm.prjct [at] gmail.com) of your decision to withdraw from this contract by a clear statement (e.g. a letter or email). An email to the address above is sufficient; you may use the model withdrawal form below.

8. Refund policy and your statutory rights
This section describes our voluntary refund policy. It is separate from, and does not limit, your statutory rights.
Voluntary policy: because the personalized report is a digital product generated and delivered immediately, we do not generally offer a discretionary refund once the report has been fully generated. If a report fails to generate due to a technical error on our side, you are entitled to a full refund or, at your option, a re-generation of the report.
Statutory rights are unaffected. Nothing in these Terms excludes or limits mandatory statutory consumer rights, including your statutory right of withdrawal to the extent it applies (section 7) and your statutory rights in respect of defective or non-conforming digital content under §§ 327 ff. BGB — for example rights to subsequent performance, to a price reduction or to terminate the contract, and any statutory claim for damages. Where a report is defective or does not conform to the contract, those statutory rights apply regardless of this voluntary policy.

9. Intellectual property
Content on TESTUNO falls into distinct categories and we do not claim ownership of material we do not own:
- TESTUNO-owned content — original item banks, scoring logic, report templates, editorial articles, design and software created by the operator. These are proprietary to the operator.
- Licensed content — material used under licence from a third party. Ownership remains with the respective rightsholder, and use is subject to the applicable licence terms.
- Open or public-domain material — instruments or content made available under an open licence or in the public domain. These remain governed by their own licence, including any attribution requirements, which we observe where applicable.
Where a test is based on a third-party or open instrument, that instrument and its items remain the property of, or subject to the licence of, the respective rightsholder — not the operator. You may not reproduce, redistribute, sell or commercially exploit content from the platform without the permission of the relevant rightsholder. Your personal test results remain yours; you may export, share (where the platform provides a share function) or delete them.
10. AI-generated content
Artificial intelligence assists with personalized paid reports, research news articles and related narrative interpretation.
How this works: your scores, bands, dimension values and percentiles are calculated deterministically by TESTUNO's own scoring logic — the AI does not determine your score. The AI produces the written interpretation of those already-calculated results.
AI-generated content is informational only and does not constitute professional advice of any kind, and specifically not a medical or psychological diagnosis. Outputs are generated from the available inputs, may be incomplete and may contain errors. You should not rely on them for decisions with significant consequences.
11. Prohibited use
You agree not to:
- Scrape, crawl or otherwise extract bulk data from the platform;
- Use automated systems to generate sessions, results or reports in a way that distorts norm data or burdens the service;
- Impersonate another person or misrepresent your identity;
- Use the platform for any unlawful purpose or in violation of these Terms.
12. Limitation of liability
Liability for intent and gross negligence, for injury to life, body or health, for the breach of essential contractual obligations, under the Product Liability Act, and any other liability that cannot be excluded or limited by law remains unaffected.
Beyond that, and to the extent permitted by law, the operator's liability for ordinary negligence is limited to foreseeable damages typical for this type of contract. The operator is not liable for indirect or consequential damages caused by ordinary negligence.
Mandatory statutory provisions, including mandatory consumer-protection law, take precedence over this section in all cases.
13. Governing law and jurisdiction
These Terms and any disputes arising from the use of TESTUNO are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the mandatory consumer-protection provisions of their country of residence remain unaffected. The place of jurisdiction is Germany to the extent permitted by law.
14. Consumer dispute resolution
We are not obliged to participate, and are not willing to participate, in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle), unless we are required to do so by law.
If you have a complaint, please contact us first at jdm.prjct [at] gmail.com — we aim to resolve issues directly. Your right to bring proceedings before the competent courts remains unaffected.
15. Account termination and data deletion
You may delete your account at any time from your profile or by contacting us. Upon deletion, your account-linked test sessions, results and personal data are removed, subject to legal retention obligations (e.g. tax-relevant payment records). Anonymised norm observations are not linked to your identity and are retained as aggregate calibration data.
16. Changes to these Terms
We may update these Terms to reflect changes in the law, the platform, or our practices. Where changes materially affect your rights, we will provide reasonable notice — for paid products, at least before your next purchase. Continued use after changes take effect constitutes acceptance.
